LANSING – The 9th Circuit U.S. Court of Appeals has agreed with lower courts, and with state attorneys general, that the U.S. Environmental Protection Agency is charged with regulating ballast water under the federal Clean Water Act.

Attorney General Mike Cox, who is participating in the California-based case on behalf of the state, announced the decision Thursday.

“The Great Lakes are Michigan’s greatest treasure, and aquatic nuisance species like the zebra mussel and sea lamprey cause significant harm to this delicate ecosystem,” Mr. Cox said. “I joined this fight with the goal of helping to preserve this environmental and economic resource for future generations.”

The federal district court had ordered regulations in place by September.
