LANSING ? Clark Hill attorneys John L. Gierak and Maria Fracassa Dwyer will conduct a free online Minimum Wage Increase: Potential Exemption Pitfalls webinar on May 31 to discuss Michigan’s minimum wage increase and its impact upon future overtime exemptions for employees.
The state minimum wage will increase to $6.95 per hour effective October 1, $7.15 per hour effective July 1, 2007 and $7.40 per hour effective July 1, 2008. More important to most Michigan employers than the wage increase itself is that fact that the increase may result in the loss of overtime exemptions for many of its employees.
The reason is that many Michigan employers have historically determined overtime exemptions according to the federal Fair Labor Standards Act (FLSA). However, because the federal minimum wage will be lower than Michigan?s minimum wage starting in October 2006, these federal exemptions from overtime liability will no longer apply. Michigan employers will have to rely upon the overtime exemptions under Michigan?s Minimum Wage Law, which are much more limited than the federal overtime exemptions.
